1. Acceptance of Terms
By accessing or using The Memory Scribe website (https://www.thememoryscribe.com) and our memoir ghostwriting applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of the Service
The Memory Scribe provides an empathetic, AI-assisted platform designed to help individuals and families document, record, and preserve life histories. Our services include:
- MemoirGhost AI Engine: Interactive conversational interviews and narrative chapter drafting.
- Story Bible Tracking: Persistent entity and timeline tracking across your autobiography.
- Book Design Studio: Custom cover cloth selection, foil stamping configuration, and interior PDF typesetting.
- Physical Print Fulfillment: Print-on-demand manufacturing and drop-shipping of hardcover books via our partner, the Lulu Print Studio.
3. Intellectual Property & Author Ownership
Your Content: All stories, personal recollections, voice audio, transcripts, and finalized chapters created or uploaded by you remain your sole intellectual property. You grant The Memory Scribe only the limited, non-exclusive license necessary to host, process, format, and transmit your content solely for the purpose of generating your manuscript and fulfilling your physical books.
Our Platform: The Memory Scribe branding, logos, visual layouts, software code, and design studio interfaces are the proprietary property of The Memory Scribe and protected by applicable copyright and trademark laws.
4. Subscriptions, Payments & Refunds
- Payment Processing: All transactions are securely processed via Stripe. By providing payment credentials, you authorize us or Stripe to charge the designated fees.
- Single Story Tier ($5.99): One-time fee granting one full chapter draft and PDF export.
- Unlimited Memoir Tier ($29.99/year): Annual recurring subscription granting unlimited chapter generation, audio vaults, and ongoing continuity auditing. You may cancel renewal at any time through your Account Settings.
- Hardcover Keepsake Package ($99.99): Includes full Unlimited digital access plus manufacturing and standard shipping of one custom printed hardcover book.
- Refund Policy: If you are dissatisfied with digital chapter generation, you may request a refund within 14 days of purchase. Once a physical hardcover book has been submitted to Lulu Print manufacturing, physical printing costs cannot be refunded unless the book arrives misprinted or damaged.
5. Hardcover Printing, Proof Approval & Fulfillment
- Proof Inspection: You are responsible for reviewing your digital book preview and cover stamping proof in the Book Studio prior to confirming your print order.
- Manufacturing & Shipping: Physical book manufacturing is fulfilled through the Lulu Print API. Production typically takes 3 to 5 business days, followed by standard carrier delivery.
- Damaged or Defective Copies: If your hardcover arrives damaged in transit or with severe binding flaws, notify us at support@thememoryscribe.com within 14 days with photos, and we will dispatch a replacement copy at no charge.
6. AI Ghostwriting Disclaimers & Editorial Responsibility
The Memory Scribe utilizes advanced artificial intelligence ("MemoirGhost") to assist in crafting literary prose from your recollections. While the AI strives for historical fidelity and emotional warmth, you acknowledge that generated drafts are creative interpretations. You maintain final editorial control and are encouraged to review dates, spelling of family names, and narrative accuracy before printing.
7. Prohibited Uses
You agree not to use the Service to:
- Upload defamatory, abusive, infringing, or illegal material.
- Attempt to circumvent security measures, reverse engineer the platform, or overload our backend API infrastructure.
- Impersonate any individual without their express written authorization.
8. Limitation of Liability
To the maximum extent permitted by law, The Memory Scribe and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total aggregate liability for any claims relating to the Service shall not exceed the amounts paid by you to The Memory Scribe in the preceding twelve (12) months.
